OpenAI Opposes Data Deletion Request

Microsoft-backed AI startup OpenAI told the Delhi High Court that removing training data used for ChatGPT would violate its legal rules in the United States. The company behind the popular AI chatbot ChatGPT also said Indian courts cannot handle a copyright case filed by ANI because OpenAI has no operations in India.

The news agency ANI filed this case in November in a Delhi court, accusing OpenAI of using its published content without permission to train ChatGPT. OpenAI replied to the lawsuit in an 86-page filing at the Delhi High Court on January 10. The lawsuit also demands the removal of ANI’s data already stored in ChatGPT.

Similar cases have been filed against OpenAI and other companies, including one by the New York Times in the US over claims of using copyrighted content to train AI models. OpenAI has repeatedly denied the allegations, saying its AI systems make fair use of publicly available data.

During a November hearing, OpenAI told the Delhi court it would not use ANI’s content anymore but the news agency argued its published works were stored in ChatGPT’s memory and should be deleted. In its January 10 filing, the ChatGPT maker said it is facing lawsuits in the US over the data used to train its models. US laws require OpenAI to keep the data while the cases are ongoing, so it cannot delete it.

ANI believes the Delhi court has jurisdiction to decide on the matter, and it would file a detailed response. OpenAI has been gearing up to transition from a non-profit enterprise into a for-profit business as it looks to capture even more funding to stay ahead in the costly AI race after raising $6.6 billion last year.
